Hello everyone, this is Hemang Laaheru I’m a lawyer and a partner at Smart Move 2UK, a division of Smart Move Immigration. Today we’re going to have a look at the process of the closure of the tier one investor visas. On 17 February 2022. Without any prior notice, the Home Secretary announced, I have closed the tier one investor route. And just like that, in a matter of minutes, a route that would allow high net worth individuals to make a substantial investment in the UK from a minimum of £2 million was closed abruptly without any notice. The Home Office published the guidance, the statement of changes a few minutes past that announcement. And just like that, the convention of closing an Immigration route 21 days after it has been tabled in the Parliament was set aside once. It is understandable that the Home Office did not want to give in an advance notice of a closure of this particular route, fearing a deluge of applications at the last minute, but that would have happened in any which case for any visa category. Putting those niceties aside, let’s look at the impact and the reasoning in terms of how this decision came about with the Home Office. The tier one investor has been a long established route open for applicants since 1994. It was brought under the points based system in 2008, subjected to a comprehensive review in 2014, and again has been reviewed in 2015 and 2019. The rationale cited in the current closure is a review of the sample applications, which were due for an extension towards the end of 2019, the report for which was published in 2020. What defies belief, though, is that these reports have been available for a length of time now and the decision to close the route for the applicants so abruptly without any notice definitely puts the genuine applicants who may not have had any security concerns but were making that decision to relocate to the UK in a jeopardy.
