Hello and welcome to 60 seconds with Sergio. I am your host, Sergio Cabanas, Attorney-at-Law here in Florida. Thank you for joining me today.
Today’s question is: „Sergio, what is a rabbinical divorce and is it valid under Florida law?“
Well, the short answer is that a rabbinical divorce, such as a „get“, is not really recognized under Florida law for divorce purposes.
There is a distinction between the state and religion when it comes to divorce.
I recognize and acknowledge the fact that many people may turn to their faith, may turn to their synagogue, temple, church for a divorce.
And that would work for religious purposes, depending on the teachings of your religion.
And it may be valid, for moral reasons, for your own psychological well-being.
However, none of these divorces are considered valid under Florida law.
Instead, Florida law recognizes divorces that are recognized by governmental institutions.
Not religious-based institutions.
Of course, I respect and understand the fact that one may feel compelled that, in addition to getting a state-recognized divorce, to obtain a religious type of divorce or follow that religious teaching.
By all means, if you feel compelled to do it, absolutely do it.
And of course, they must also give you some emotional, psychological well-being.
All of it is perfectly fine and, in fact, encouraged. However, just recognize that what belongs in the religious realm, isn’t necessarily recognized in the state realm.
So, it’s important to obtain a legally recognized divorce in a governmental institution.
Depending on the advice of your attorney, license, in whatever jurisdiction you are seeking to divorce.
