his is a common question because there are many states within the United States and, in fact, many countries around the world, that require a spouse to establish some kind of a legal reason, or some kind of a legal justification, in order to obtain a divorce.
For example, you had to prove up that the other spouse engaged in some kind of an extramarital affair. Or that the woman, in a case of a man marrying a woman, the woman is not able to have children, for whatever medical reasons there may be.
In fact, under Florida law, you had to have proof that you fall within one of the legal reasons to be entitled to a divorce. Such as an extramarital affair, or that the other woman is not able to have children, or some other legal reason.
But that’s no longer the case. Florida law has changed. All one party has to declare, not even prove, but just declare that the marriage is irretrievably broken.
Meaning that the marriage is beyond repair, there is no chance for reconciliation. So, how do you show that the marriage is irretrievable broken as required by Florida law? All you have to simply state in your petition for the paperwork for the divorce is just that, the marriage is irretrievable broken, and that’s all you have to show, not even prove it.
